The Protection of Pupil Rights Amendment (PPRA), also known as the Hatch Amendment, governs the administration of surveys, assessments and evaluations given by a state or local education agency (LEA) that receives federal funding and specifically addresses eight protected areas. Additionally PPRA requires LEAs, in consultation with parents, to develop local policies concerning student privacy and parents’ access to information. School counselors who administer needs assessments, universal screenings and other surveys that seek information must be aware of the eight PPRA-protected areas, school board policy, and legal and ethical concerns. Learn about survey questions that fall into protected areas, when active consent is needed, when passive consent is acceptable and the implications of using standardized universal screening assessments as well as school-counselor-created needs assessments.
